Jayalalithaa reshuffles cabinet, drops two ministers

Chennai : Tamil Nadu Chief Minister J. Jayalalithaa Monday reshuffled her cabinet, dropping two ministers and adding two, and also reallocating three portfolios.

In a statement issued by the Raj Bhavan here, Governor K. Rosaiah on Jayalalithaa's recommendation dropped S.T. Chellapandan, minister for labour, and A. Mohammedian, minister for backward classes and minorities' welfare.

According to the statement, S.P. Shunmuganathan and S. Abdul Rahim are being inducted into the cabinet as tourism minister and backward classes and minorities welfare minister respectively.

The swearing-in ceremony is scheduled for Tuesday evening.

Rosaiah also approved the changes in the portfolios of some of the ministers as per Jayalalithaa's recommendations.

As per the fresh allocation of portfolios, K.T. Pachaimal has been made labour minister, while M.S.M. Anandan is the new minister for forests.

P. Chendur Pandian has been appointed minister for Hindu religious and charitable endowments.


Ghaziabad custodial death: 12 ante-mortem injuries, says report

Ghaziabad : The autopsy conducted on a suspected auto lifter who allegedly died in police custody revealed 12 ante-mortem injuries even as his kin accused police of offering them Rs.15 lakh as bribe to withdraw their complaint.

Mohammad Shakeel's body bore abrasions on the back, legs and arms, the report stated.

The family's counsel said residents of Dasna in Ghaziabad, where Shakeel lived, would go to Lucknow to apprise Samajawadi Party chief Mulayam Singh Yadav and Chief Minister Akhilesh Yadav about the police's atrocities.

"The autopsy on Shakeel's body found ante-mortem injuries on him. He also had tuberculosis," Uttar Pradesh Deputy Inspector General of Police K. Satyanarayan had said Sunday.

A departmental inquiry has been ordered against all eight policemen following the death of Mohammad Shakeel Friday night, police had said Saturday.

The death, which the victim's father alleged occurred due to torture, took place at the Kavi Nagar police station, according to one account.

Police sources, however, said that Shakeel succumbed to injuries sustained earlier while being treated at a hospital in Ghaziabad.

Police said that after he confessed to stealing some vehicles, it was decided to take Shakeel to Ferozabad to recover the vehicles. On the way, he reportedly complained of chest pain and vomitted.

On a complaint by Shakeel's father Mohammad Khaleel, a case was registered against the eight police personnel.

Khaleel accused police of torturing his son for two days and of taking away his mobile phone and Rs.61,000 in cash.

Guwahati: They came braving the brightest sun on a summer noon to express their feelings. This is a bunch of people of Palhaji, a remote area of Barpeta district in Assam, some 100 odd kilometre from state capital Guwahati who are given a platform by newly launched monthly magazine ‘Balichanda’ to express their problems. Because the problems they are facing in their day to day life are more painful than the scorching summer sun.

The magazine edited by Char Sapori Sahitya Parishad (CSSP) president Hafiz Ahmed is an effort to bring the voice of such people whose voice is never heard. “The problems of these people have never been the problem of the state. They have been living in the country for second class citizen. So, here is an effort on our part to bring their problems on record. We cannot change their destiny but we can try to make their voice heard,” said Hafiz Ahmed.

Accordingly, Hafiz Ahmed and co travel to the remotest parts of the state where these downtrodden people reside once in every month to listen to their voice organizing an event called Raij Mel which means Public meet in Assamese.

Probably one of the most neglected areas of the state at the present time. The people of the locality were pretty excited to meet the team as they hardly get such an opportunity when somebody listens to their problems leave alone solving it.

“Sometimes we feel like orphans. Why on earth the government has no time to have a look at us. We are being treated as second class citizen as if we have no right to get the facilities given by the constitution of India,” rued 86 year old Omar Uddin Khan who is the first of the entire locality to have a Bachelor degree in Science in 1958 from Cotton College.

Palhaji is a place where most of the people work in agriculture field and do petty trade to make ends meet. And they have number of problems from transportation to health care system and many others.

This is one of the deadliest problems the entire state is facing and the Palhaji residents are also no exception. So far, since the independence the area has lost around 20 villages to the mighty Brahmaputra thus making around 2 lakh people homeless.

“So, this is the reality. But the important thing is that these 2 lakh people have no proper address at the present time. Some have settled in some forest areas while the others have left for other places as daily wage earners. There has not been any helping hand from the government for these people,” Khan, one of the senior most person of the locality who was also the principal of Mandia Higher Secondary School said.

He also said that earlier it was 10 kilometres to the river from Palhaji market which has been reduced to mere 1 kilometre. “We think, in the next 10 years or so we will be no where if appropriate steps are taken. All the important places including the Sattras (Vashnavite Monastery) will be washed out,” said Mujibur Rahman, another local.

So, they all urge upon the government to come to the place and do something. Their demands include a bridge over Brahmaputra connecting Bohori and Sontoli in Kamrup district. “If it can happen in Goalpara and in Dibrugarh why not here? This is also one of the busiest areas. This will bring a solution to a long time problem of transportation besides the erosion,” Khan added.

There is just a Primary Health Centre (PHC) at a place called Bhella six kilometre from Palhaji to cater the need of around 1.5 lakh people. Otherwise, all they have to go to Barpeta which is around 15 kilometres away. Whereas, according to the department of health of Assam government norm a PHC should be there for every 20, 000 people.

“Moreover, the road are so poor that during summers we have to face horrible moments to travel here and if you have a patient with you, it’s hell,” said Imdadullah, a local youth.

Agriculture, poor economy and the victims of chit funds

Though most the people engage in agriculture activities of the locality, there is hardly any facility for them to better performance. “Our farmers still engage in age old systems. There is no facility for irrigation to water the fields,” said one of them.

Another shocking thing here is that there is no branch of any bank for the need of the locals and as a result many were became the victims of the chit funds. People either have to go to Bhella or Patbausi for banking activities.

“As there was no banks the chit funds could easily made the poor simple people to invest money in them. This was really unfortunate how these poor people were looted. So, we demand that at least one branch of any nationalized bank should be here at Palhaji,” Imdadullah added.

Another humiliating pain these people are suffering is from the Bangladeshi tag.
“Every now and then people would say us Bangladeshi. We were born and brought up here like any other. It is true that our forefathers have migrated from the undivided Bengal way back in beginning of 20th century. So, it’s very embarrassing,” said Talebar Rahman, principal of Palhaji Higher Secondary School.

He also said that when the erosion affected people who are go out seeking jobs are often targeted as Bangladeshi people.

The Balichanda magazine team also felicitated the students of the locality who excelled in the recently declared class 10 and 12th exams.

“Our sincere efforts will continue to make their voice heard. Otherwise they are neglected as second class citizens. Be it religious minorities, the tea tribe people and others who have been suffering in oppression and suppression, we will try to give them a voice,” said Khabir Ahmed, author and poet.

Lucknow: Heath condition took a turn for the worse for Akhilendra Pratap Singh, convenor of All INdia Peoples's Front (IPF), who is on a ten-day fast for seeking justice in Khalid Mujahid's custodial death case.

Singh has been on fast for the last eight day. He is passing ketone and protien in his urine, his blood pressure is elevated and pulse rate high, according to doctors monitoring his health.



Unfazed, Akhilendra Pratap Singh said that if the state government doesn't heed to our demands then I am willing to extend the fast beyond the planned ten days.

Singh of IPF is supported by Rashtriya Ulama council, Communist Party of India (Marxist), Socialist Party(India), and Rashtriya Communist Party.

Deposit Rs.10,000 to meet dying mother, court orders terror accused

Mumbai : A special court here ordered an accused in the July 2006 Mumbai serial train blasts case to deposit Rs.10,000 if he wanted to visit his ailing mother with an escort, his lawyer said Monday.

The accused, Mohammed Sajid M. Ansari, who is booked under the dreaded Maharashtra Control of Organised Crime Act (MCOCA), had filed a plea seeking four weeks' interim bail to visit and care for his dying mother.

MCOCA Special Judge Y. D. Shinde rejected Ansari's application on ground that there is no such provision for bail or interim bail under the law (MCOCA).

However, granting relief, Shinde said that the accused could deposit an amount of Rs.10,000 with the court and visit his mother for six hours Tuesday at a hospital in suburban Jogeshwari where she is being treated.

Ansari had pleaded in his interim bail application that his mother was unconscious and virtually on her death bed. Whenever she regained consciousness, she asked to meet her son who is in jail, said his lawyer, Shahid N. Ansari of NGO Jamiat Ulama-e-Maharashtra (AM).

The lawyer said that since the accused could not afford to collect the money, the NGoarranged to deposit the entire amount before the court and he will visit his mother Tuesday with a police escort team.

Incidentally, lawyer Ansari said that last year, the accused Ansari's sister had died and though he was permitted to attend her funeral, he could not make it since the police escort team was delayed.

BJP accuses Akhilesh government of being communal

Lucknow : The Bharatiya Janata Party (BJP) Tuesday criticised the Akhilesh Yadav government and accused it of indulging in communal and appeasement politics.

Pointing out how the Uttar Pradesh Police on a social network site had called rioters in Shamli agitating against rape of a minor girl as a 'Hindu girl', BJP state spokesman Vijay Bahadur Pathak said the fact that the UP government was trying to label rape victims on religious lines was very disturbing.

"On official page of the UP police if they call the victim as a Hindu girl and rapists as Muslims, how far can the Samajwadi Party (SP) stoop now," he angrily questioned.

He also criticised the state government for detaining its leader in the state assembly Hukum Singh and legislator Suresh Rana for intervening in the matter.

The BJP has also raked up the issue of no compensation to R.P. Dwivedi, a policeman who was shot dead by criminals last week in Allahabad.

"This government has given Rs.50 lakh to the family of deputy SP Zia ul Haq and two jobs, given Rs.6 lakh to terror accused who died in police custody, Rs.5 lakh to a custodial death in Ghaziabad, largely because all these were Muslims," Pathak said while pointing out how no senior minister in the Akhilesh Yadav government had even cared to visit the family of the slain cop.

There has been no announcement of ex gratia as in other cases, he added.

VHP refutes media report on Modi's Ayodhya visit

Lucknow : The Vishwa Hindu Parishad (VHP) Tuesday refuted a media report that Gujarat Chief Minister Narendra Modi is scheduled to visit the disputed Ram Janma Bhoomi site in Uttar Pradesh's Ayodhya town later this month.

"I have been quoted as commenting on the visit of Narendra Modi. But I am hereby officially refuting any such comment being attributed to me," Sharad Sharma, regional media in-charge of the VHP in Ayodhya, said in a statement.

Saying that a news agency quoted him out of context regarding the Ayodhya visit of Modi, Sharma added that he did not receive such intimation from the head of Bharatiya Janata Party's poll campaign panel for the 2014 general elections.

The 75th birthday of Mahant Nritya Gopal Das, seer and chairman of the Shri Ram Janmabhoomi Nyas, is being celebrated in the temple town from June 19 to 22. VHP sources said that invites have been sent to many politicians and VIPs across the country.

The invitees include the Gujarat chief minister, Madhya Pradesh Chief Minister Shivraj Singh Chauhan and several central leaders of the BJP.

A close aide of Nritya Gopal Das, however, told IANS that Modi has already apologised to the seer for not being able to make it on June 19 for the celebrations.

"Modi ji called up Mahant ji two days back and expressed his inability to come to Ayodhya citing preoccupations," the aide said.

Earlier, the news of Modi's Ayodhya visit sent the media and political establishment in a tizzy with many pointing out that the Janata Dal-United was correct in parting ways with the BJP, as the saffron outfit was trying to reignite the Ayodhya brand of politics.

Although officially remaining silent on the issue, the state BJP leaders termed as contradictory the media report quoting Sharma and other people on Modi's Ayodhya visit.

AMU Centres to be handed over to Minority Affairs Ministry, alumni unhappy

In a recent development the Ministry of Minority Affairs has urged to take over the off-campus centres of Aligarh Muslim University (AMU) outside Aligarh at Murshidabad (West Bengal), Mallapuram (Kerala) and Kishanganj (Bihar). Informed sources said that Aligarh Muslim University (AMU) will hand over its three centres to the Ministry of Minority Affairs (MoMA) for their upgrade as independent universities.

The new development related to AMU centres somehow came as a shocker for those wishing to see campus of legendary AMU outside Aligarh. Mohd Mudassir Alam, an AMU old boy and resident of Kishanganj said, “I was dreaming to see a replica of Aligarh Muslim University since it was announced four years back. I have been deeply attached with both AMU and Kishanganj, hence it become more important and a matter of pleasure for me to see a centre here at Kishanganj. However, the proposal of Minority Affairs Ministry has literally shattered my dreams and many thousands like me.”

Further Mudassir said, “all know very well the response of the Minority Affairs Ministry when it comes to action regarding implementation of educational projects and schemes. Still the proposal of opening three minority universities namely Rafi Ahmad Kidwai University at Kishanganj (Bihar), Tipu Sultan University at Mysore (Karnatak) and Khwaja Gharib Nawaz University at Ajmer (Rajasthan) is hanging in balance. There is hardly any development in the project since it was announced around four year back by the former Minister Salman Khursheed.” “Neither the ministry nor the concerned state governments and wakf boards have taken any bold step to set up the earlier declared minority universities. Now taking over the AMU centres can be called an ambitious step without any foothold at the ground zero,” mentioned Mudassir.

AMU Registrar Captain Shahrukh Shamshad in his statement to media said, talks are on with MoMA in this regard for handing over our three existing centres to them for developing as independent universities. The ministry has given us such a proposal and we are considering it. It is likely that they will be handed over to the ministry. He said, AMU Court, the apex body of the university, too, has given its consent during its meeting held on June 12

At present, the academic session is going on at the Mallapuram and Murshidabad centres while the Kishanganj centre is still under construction. Their funding is done through separate allocations done by the Ministry of Human Resource and Development. "Once they are separated, their funding and control will be directly done by the government. Then AMU will have no control over them. They will be independent universities," added Shamshad.


BJP strife like civil war on reality TV: Tewari

New Delhi : The internal strife in the BJP is like a "civil war playing out on reality television", Information and Broadcasting Minister Manish Tewari said Tuesday, in a dig at the national opposition party.

"What is happening in the BJP is their internal matter. It is a civil war situation playing out like reality television," said the minister when asked to comment on Bharatiya Janata Party strongman and Gujarat Chief Minister Narendra Modi going to meet party veteran L.K. Advani who has not shied from displaying his reservations against Modi’s elevation in the party.

Advani had resigned from party posts after Modi was made in charge of the BJP's 2014 election campaign, but withdrew his resignation later. Modi, who is touted as the party’s likely prime ministerial candidate for 2014, met Advani Tuesday morning.

Tewari said “the larger question” behind Modi’s elevation needed to be dealt with. He said after Modi was made chief minister in 2001 the Gujarat riots followed in 2002 that “demolished communal harmony”.

"Now that he is bound for Delhi, the BJP itself stands demolished,” he said, referring to the dissension in the party where a section is staunchly pro-Modi and for his elevation as prime ministerial candidate, while a section is reported to have its reservations against the move.

The BJP’s long-time partner, the Janata Dal-United (JD-U), too has parted ways from the BJP after 17 years following Modi’s elevation.

Tewari said the people of the country “would be well served” to keep in mind these developments concerning Modi.

To a question on Modi showcasing his secular bent, Tewari said the people should decide on his secular credentials keeping the 2002 riots in mind.

BJP foresees political re-alignment after elections

Hyderabad : Denying that the NDA has weakened with the Janata Dal-United pulling out, the Bharatiya Janata Party (BJP) has predicted a re-alignment of political forces before and after the next Lok Sabha election.

Senior BJP leader M. Venkaiah Naidu hopes that political parties opposed to the Congress would join hands with the BJP.

"There was a similar situation earlier. When elections came close and elections were over, 23 parties joined hands with us. Today BJP may cross 200 (seats in Lok Sabha). In that case, you will see which parties join us," he told reporters here Tuesday.

"I don't want to take names but the parties which are opposed to the Congress will support the BJP," he said when asked if he was hopeful of JD-U coming back to the NDA fold.

Naidu said it was ridiculous that the proponents of the Federal Front were counting as allies parties which are not allies of BJP.

"How can the parties which are opposing each other in different states join the same front?" he asked.

Denying that the BJP was going back to Hindutva, he said the party's agenda in the coming election would be speedy development. Asked about Gujarat Chief Minister Narendra Modi's proposed visit to Ayodhya, he said he would be there to take part in a programme.

The BJP leader said the JD-U had not made clear the reasons for severing ties with the BJP.

"There is something more than what meets the eye," he said, pointing out that Bihar Chief Minister Nitish Kumar had praised Modi in 2003.

He said people were tired of hearing about secularism and communalism, and said they desired development.

I have a right to know who killed my daughter

My daughter Ishrat Jehan was abducted, illegally confined and killed in cold blood by officers and men of the Gujarat police, in June 2004. She was killed as part of a larger conspiracy which had a political agenda. Ishrat’s murder was projected as an ‘encounter’ and justified by branding her a terrorist who had come with 3 other men to attack the Gujarat Chief Minister Narendra Modi. This was not the first fake encounter in Gujarat, other Muslims too had been executed in similar staged encounters, committed in the name of protecting the Chief Minister of Gujarat. Some of these other fake encounters, which are nothing but pre meditated extra judicial killings, are already under investigation and prosecution.

My young college going daughter, Ishrat, was studying and working to earn and support her brothers and sisters, after the death of her father. Since the day of her murder, I have been stating that my daughter was innocent and had no links whatsoever with any terrorist or criminal activity. The same was categorically asserted by me in the Writ Petition filed by me in August 2004, before the Gujarat High Court, seeking a CBI enquiry to establish the innocence of my daughter and justice through punishment of her killers.

For nine long years the Gujarat state, has abused its power, to obstruct, delay and derail the investigation, so that the hands and masterminds behind this heinous crime are shielded from legal accountability. The State of Gujarat and its senior IPS officers have filed frivolous and vexatious petitions in the Supreme Court, coerced witnesses, and deployed many other unlawful tactics. My lawyers have resolutely met each challenge and worked to uncover the truth.

The report of the judicial enquiry by the Magistrate Shri S.P. Tamang, in September 2009, concluded that my daughter was innocent and had been murdered by Gujarat police officers and men. The SIT appointed by the Gujarat High Court, under the Chairmanship of Shri R.R. Verma, too concluded in 2011, that the encounter was fake and not genuine and that Ishrat Jehan had been killed in prior custody. Under directions of the Gujarat High Court the investigation was transferred to the CBI and a FIR for murder and other grave crimes lodged in 2011.

The CBI is investigating the murder of my daughter and 3 others. This investigation is being monitored by the Gujarat High Court and a status report of the investigation is regularly filed before the High Court. I have always placed my faith in the Court and pray that the Hon’ble High Court will ensure that my struggle for justice is not in vain. The CBI investigation has already led to the arrest of many senior Gujarat police officers and men. The CBI investigation has revealed that complicit in the staged fake encounter of Ishrat and 3 others in 2004, were not only police officers of Gujarat, but others as well.

The evidence collected by the CBI, as expressed to the High Court on the last date of hearing i.e. 14th June 2013, points to a larger conspiracy. The conspiracy appears to include Mr. Rajendra Kumar a senior officer of the Intelligence Bureau. The CBI counsel stated before the High Court on 14th June, 2013, that their investigation shows that IB Officer Mr. Rajendra Kumar not only knew about the illegal detention of my daughter Ishrat but was directing the operations. I am astonished and distressed to hear that attempts are being made to protect Mr. Rajendra Kumar from arrest and custodial interrogation by the CBI.

I am also surprised that the media is projecting the CBI investigation as an attack on the institution of IB. To my mind, what is worrying, if not dangerous, for the security of India, is if high ranking officers in institutions such as the IB, abuse their position and fabricate information, to advance a communal and politically motivated agenda. It is in the interest of the country if such people are weeded out of the IB and the security of all the people of India protected.

Clearly, the investigation of the CBI is moving in the right direction and to thwart it a very crude and motivated move was orchestrated, by planting some audio-tapes with a private media channel viz. Headlines Today. There is not a whisper of allegation against my daughter Ishrat Jehan in these so-called IB audio recordings. Significantly the timing of the broadcast of these tapes, on 13th June 2013, by a compliant private TV channel, the night before the hearing by the High Court, not only makes them highly suspect, but in fact betrays that they are desperate to shield the guilty. I would like to state here that my lawyers will be sending a legal notice and will initiate appropriate legal action against Headlines Today TV channel for the false, scandalous and defamatory statements made against my deceased daughter Ishrat Jehan.

When the next day the Additional Advocate General of Gujarat, brandished these planted and concocted CDs before the High Court, on 14th June, 2013 and made specious arguments for them to be taken on record, the nefarious design and purpose was clear to all. The Gujarat High Court not only rejected this fallacious plea of the State of Gujarat, but also sternly reminded it of its constitutional duty to protect its citizens and admonished it for continually obstructing the investigation into the staged encounter.

I strongly reject and denounce each and every allegation and statement that refers to my deceased daughter Ishrat Jehan as being a terrorist or having any links with any terrorist activity or group. In the past too attempts have been made to taint the name of deceased Ishrat by planting false, concocted and baseless news reports. What is significant is that the judicial enquiry and impartial and professional investigation have always upheld the innocence of Ishrat.

The State of Gujarat has on each hearing before the High Court argued strenuously to disrupt and disturb the CBI team that is investigating the killing of Ishrat and others. As I observe the progress of this investigation, I ask the following questions. Why is the State of Gujarat so keen, almost desperate to remove Mr. Satish Verma, IPS, from this investigation? What does the State of Gujarat fear this diligent and honest investigation will reveal? Who are the persons the State of Gujarat is trying to protect?

I have a right to know the complete truth – who killed my daughter Ishrat Jehan, who masterminded her murder, who stood to gain from the cold blooded killing of a young Muslim girl. I have a right to complete justice, and for that it is necessary that the entire conspiracy is unearthed and all those responsible for eliminating my innocent daughter are indicted, charged prosecuted and punished.

Bareily: Social Organisation ‘Paigham-e-Insaniat’ organised an educational conference at IMA Hall, Bareilly in which Justice M.S.A Siddiqui, Chairman, National Commission for Minority Educational Institutions and professor of Law at Aligarh Muslim University Dr. Shakeel Samdani participated as Chief Guest and Guest of Honour respectively.

Addressing the gathering Justice Siddiqui said that education is essential for the bright future of the community and Muslims should improve the standard of their educational institutions. He said that the Muslim community can face the challenges of 21st century through education only, that’s why the community should focus on education. He further added that this is the responsibility of social workers and intellectuals of the community to sensitise the people about acquiring knowledge.

Justice Siddiqui further said that he tried his best to discharge the duties of the Commission as its Chairman and has recognised maximum number of institutions, but at the same time never compromised with the standard and quality. He said that the maximum benefit (80%) was taken by the Christian organisations and only 20% benefit has been taken by Muslim institutions. He appreciated the Summer Islamic Classes organised by Paigham-e-Insaniat.

Guest of Honour, Dr.Shakeel Samdani said that for success a Muslim has to follow the path shown by Almighty Allah and his beloved Prophet (SAW). He said that in the past Muslims have ruled in the world but that was due to the fact that they never deviated from the path shown by ‘Shariat’. They achieved success everywhere and in every walk of life but for the last few centuries they are lagging behind in every field.

He said that the Muslim countries have largest reservoirs of natural resources in their hands, but they are not taking any advantage of that, now the only thing required is awareness and to remove inferiority complex from them. He said that in the past Muslims didn’t pay attention to female education and they suffered heavily but now the community is giving due attention on female education. We do hope that we will witness good result in future. He said that in the last twenty years the community`s educational graph has gone up and now our boys and girls are being selected in civil services, judiciary & other eminent services in perceptible numbers, this is due to the continuous struggle and hard work by the young generation. He stressed if they had been given reservation in jobs and educational institutions the result would have been far more impressive.

Dr. Shakeel Samdani said that no one can deny the importance of English and Hindi but for Indian Muslims Urdu is also very important because it is their mother tongue. The entire Islamic literature is either in Persian or in Urdu. For the` Milli` issues Urdu media is doing a wonderful job, that’s why Urdu language should be preserved and developed. He appealed to the audience to purchase one Urdu news paper daily. He also congratulated the organizers for having organized such a beautiful and apt programme.

Islamic summer classes are arranged by Paigham-e-Insaniat, for the last twelve years in Bareilly. This year also Islamic classes were arranged for ten days for boys and girls both. The prize and certificate distribution programme was organised to give prizes to the students who secured good marks and also for the boys and the girls who achieved great success in U.P Board, C.B.S.E and I.C.S.E Examination. The programme was conducted by Ahmad Aziz. The soul behind the programme was Dr. Ejaz Hasan Khan, who welcomed the guests. Dr.Shariq Wadood, co-ordinator of the programme and member Shoora, presented the report of the classes. Dr. Tahir Beg presented a thought provoking paper on Muslim education and Sachhar Committee.

The special feature of the programme that lasted more than five hours was that the women outnumbered men.

More flights for repatriation of Indians from Saudi Arabia

Dubai : Additional flights will operate between Saudi Arabia and India to help in the repatriation of illegal Indian expatriates who want to return to India from the Gulf nation, a top Indian diplomat has said.

"The embassy has taken up the issue with the Indian authorities, and accordingly Air India, the national flag carrier, has expressed its readiness to operate flights," the Saudi Gazette Tuesday quoted Faiz Ahmed Kidwai, India's consul general in Jeddah, as telling a gathering of the Indian community.

"If there are many people who are ready to go but there are no seats available, then we will arrange additional flights."

Expatriate workers in Saudi Arabia are rushing to take advantage of a grace period offered by the authorities to either rectify their residency status or return to their respective countries after the implementation of a new labour policy.

The Nitaqat or Saudiisation policy makes it mandatory for all Saudi companies to reserve 10 percent of jobs for Saudi nationals.

The grace period, currently under way, will expire July 3.

Urging all illegal Indian nationals to register their names without wasting any more time, Kidwai said: "Seize the golden opportunity either to correct the work and residency status or leave the kingdom (of Saudi Arabia) before the deadline. First register at the embassy or consulate to avoid any penal action."

There are around two million expatriate Indians in Saudi Arabia, many of them blue collar workers.

Azam Khan assures action in Ghaziabad custodial death

Ghaziabad : Samajwadi Party (SP) leader Mohammad Azam Khan Tuesday met the father of a suspected auto lifter who allegedly died in police custody here and assured him of action against the police personnel if they were found guilty.

Khan met the victim Mohammad Shakeel's father Mohammad Khaleel a day after the family's counsel said residents of Dasna in Ghaziabad, where Shakeel lived, would go to Lucknow to apprise SP chief Mulayam Singh Yadav and Chief Minister Akhilesh Yadav about the police's atrocities.

The death, which the victim's father alleged occurred due to torture, took place at the Kavi Nagar police station, according to one account.

Police sources, however, said that Shakeel succumbed to injuries sustained earlier while being treated at a hospital in Ghaziabad.

The autopsy conducted on Shakeel revealed 12 ante-mortem injuries even as his kin accused police of offering them Rs.15 lakh as bribe to withdraw their complaint.

Mohammad Shakeel's body bore abrasions on the back, legs and arms, the report stated.

Modi meets Advani

New Delhi : In what is being seen as a reconciliation effort, Gujarat Chief Minister Narendra Modi met senior BJP leader L.K. Advani here Tuesday, a week after the patriarch quit all party posts following the former's elevation as the BJP's campaign committee chief.

He also visited ailing former prime minister Atal Bihari Vajpayee, and met senior party leader Murli Manohar Joshi.

The Gujarat chief minister, who is on his first visit to Delhi since the Bharatiya Janata Party's Goa conclave where he was elevated, met Advani at his residence. The meeting lasted nearly an hour.

Sources said that in the meeting, Modi told Advani that he remains the patriarch of the BJP.

Advani quit key leadership posts June 10 and hit out at his colleagues. But he made a dramatic u-turn the next day after the Rashtriya Swayamsewak Sangh (RSS) intervened.

The apparent climbdown by Advani came after RSS chief Mohan Bhagwat persuaded him to reverse his decision to resign from the BJP's national executive, the parliamentary board and the election committee.

Key ally Janata Dal-United, meanwhile, quit the National Democratic Alliance following Modi's appointment as the campaign committee chief.

According to sources, Modi also assured Advani that BJP will win the 2014 general elections even without allies.


Jiah Khan's letter will be sent to handwriting expert: Police

Mumbai : A police officer has termed as "media speculation" that late actress Jiah Khan's six-page letter does not match her handwriting, saying that no such statement had been released and the letter would be sent for forensic examination.

"There is no new development as such. All these reports in the media which say that the handwriting does not match are media speculation. We have not released any such statement. The letter willnow be sent to forensic experts," Vishwas Nangre Patil, Additional Commissioner of Police (West), told IANS.

Jiah Khan committed suicide June 3 and before her death she reportedly wrote the letter in which she talked about her doomed relationship with alleged boyfriend Sooraj Pancholi, the son of actors Zarina Wahab and Aditya Pancholi.

It is being speculated that Jiah's handwriting does not match that of the letter.

Kavita, Jiah's younger sister, told IANS: "This is all speculation. The letter was written by her only. Why would anyone do this for no reason?"

Sooraj was arrested June 10 in connection with the suicide of the "Nishabd" actress is in judicial custody. His bail plea hearing is June 21.

Ahead of vote, Nitish confident of proving majority

Patna : Bihar Chief Minister Nitish Kumar is confident of proving his majority in the assembly Wednesday after dumping the BJP as an ally, party leaders said Tuesday.

Janata Dal-United (JD-U) leaders said Nitish Kumar was "calm and cool" and spent the day in office Tuesday, not worried about the trust vote in the 243-seat legislature.

Soon after the JD-U ended its 17-year-old alliance with the Bharatiya Janata Party Sunday, the chief minister vowed to seek a vote of confidence at a special session of the state assembly Wednesday.

"Nitish Kumar was busy as usual in office work. He was not at all tense," an official in the chief minister's office said.

Nitish Kumar called off the alliance with the BJP and his colleague Sharad Yadav quit as the convenor of the BJP-led National Democratic Alliance (NDA) following differences with the BJP over the growing clout of Gujarat Chief Minister Narendra Modi.

JD-U spokesperson Neeraj Kumar told IANS that Wednesday's trust vote would be smooth sailing for Nitish Kumar.

The JD-U is four short of majority but is confident of bagging the adequate numbers despite opposition from friend-turned-foe BJP and Lalu Prasad's Rashtriya Janata Dal (RJD).

The ruling party is primarily banking on the six independents.

"After four of the six independent legislators announced their support to Nitish Kumar, the sole LJP legislator, Zakir Hussain Khan, has also announced his support to the government," Neeraj Kumar said.

"We have the magic number of 122 including 118 JD-U legislators, four independents and one LJP legislator," he added.

The independents supporting Nitish Kumar are Pawan Kumar Jaiswal, Som Prakash Singh, Vinay Bihari and Dulal Chandra Goswami.

Bihar JD-U president Bashisht Narain Singh said all its legislators barring Goh representative Ranvijay Singh, who is in prison, attended the legislative party meeting here.

According to JD-U leaders, the Congress with four legislators is likely to abstain during the vote of confidence. The lone CPI legislator is unlikely to vote against Nitish Kumar.

The BJP, with 91 legislators, has stated it was prepared to sit in the opposition.

"The Nitish Kumar government is safe and sure to prove majority in the house with the support of like-minded secular parties," Neeraj Kumar said.

Lalu Prasad has vowed to vote against the JD-U. His RJD has 22 legislators.

"My party will definitely vote against the government during the trust vote," he told the media here.

Planning Commission finds holes in Modi's much vaunted Gujarat growth model

New Delhi : Gujarat continues to be one of the fastest growing states in India, but its growth may not be as as inclusive as Chief Minister Narendra Modi claims.

The Planning Commission notes that the state is one of the biggest contributors to the country's gross domestic product (GDP). It states that in agriculture and allied ctivities, the average growth performance in the 11th Plan period was higher than what was achieved by the country as a whole.

But its performance in lifting people below the poverty line is not as remarkable as other states. Gujarat saw a paltry 8.6 percent reduction in poverty when compared to other states like Odisha, which had a 20 percent reduction in poverty in same period. And the rate at which poverty is reduced among Scheduled Tribes and Muslims is among the lowest in Gujarat.

During a meeting to finalise the state's Annual Plan for 2013-14, the Commission drew attention to the fact that Gujarat's performance in the social sector lagged behind what could be expected from a high growth State. Of particular concern in this context was the level of the child sex ratio (CSR), infant mortality rate, MMR and malnutrition.

Between 2001 and 2011 there has been an improvement at the State level for the child sex ratio, but this consists of deterioration in about half of the districts, offset by gains in the others.

In the area of malnutrition, evidence suggests that malnutrition levels were higher than what the advanced economic level of the state should have warranted.

The Commission emphasised the importance of agriculture growth for inclusiveness and its chairman Montek Singh Ahluwalia said the state " needs to pay special attention on social sector".

The state government responded that it shared the concerns of the Commission on the importance of social sector development and spelt out the initiatives that it has adopted to remedy the situation.

It spoke about planning a second phase for their growth initiative in the farm sector, including establishment of front-end facilities and a further thrust in animal husbandry.

The Commission noted the initiatives taken by the state in areas of infrastructure development, rural roads, watershed management and skill development. The Kaushalya Vardhan Kendra (KVK) has been recognised for its innovation and success.

At the meeting, the state government raised issues where it felt the central government policies needed to be reviewed to improve resource allocation for efficiency and to avoid creating impediments in the path for development.

UP police misleading courts in terror cases

Senior journalist AshishKhetan has written a letter petition in public interest to the Allahabad HC wherein he claims that evidences of innocence of Khalid Mujahid and other co-accused were deliberately kept away from the court.

Lucknow: Senior Investigative journalist and founder of investigative news-portal Gulail.com, AshishKhetan has written a letter petition to the Chief Justice of the Allahabad High Court seeking intervention into the arrest of Muslim youths on dubious terror charges.

Through his investigations and researches, Khetan claims to have found documents that according to him clearly show that t Muse cases against Muslim youths –most of whom are from poor background – were fabricated.

Placing all the documents he has gathered, Khetan writes in the letter petition, written in public interest, “an overwhelming number of terror cases different police agencies have misled the courts in particular and the people in general by wrongly implicating innocent members of the minority community.”

Referring to Khalid Mujahid, who was charged in Lucknow and Faizabad Courts Blasts, 2007 and who died in custody last month after spending more than six years in jail, Khetan writes, “The material I’m placing before this court shows that the evidence of his innocence as well as that of his three co-accused was deliberately kept from the courts.”

In five other cases, Khetan claims to have researched in which the accused have been languishing in jail for seven to eight years. He adds that in one such instance even a ten-year sentence has been pronounced. Referring to the case, he writes, “The material I’m placing before this court shows that Waliullah too was not involved in bomb blasts for which he had been charged. The matter thus is of great moment and equally great urgency.”

Khetan, during his earlier tenure with the weekly magazine Tehelka did a sting operation and authored investigative reports on many important cases including those arising from the Gujarat riots of 2002, such as the NarodaGaon, NarodaPatiya and Gulberg Society massacres and the Best Bakery carnage.

It was after his ‘sting operation’ in the infamous Best Bakery case, the Supreme Court had constituted a Quasi Judicial Committee headed by the then Registrar General, Supreme Court.

Listing the seven terror cases Khetan claims, “In all these abovementioned cases the UP Police have arrested and sent for trial nine members of the Muslim Community who have been in jail for anywhere between six to eight years.” Those cases are:

(i) SankatMochanMandir Blast, 7 March, 2006, Varanasi.

(ii) Cantonment Railway Station Blast, 7 March, 2006, Varanasi

(iii) Triple Blasts, 22 May, 2007, Gorakhpur.

(iv) Varanasi Court Blast, 23 November, 2007.

Khetan further added, “The internal records that I am presenting before this court suggest that an entirely different set of accused than those who had been originally arrested and chargesheeted in these seven cases are believed by other terror investigation agencies to be involved in these cases.”

In the case of Lucknow and Faizabad Court Blasts and also in the Gorakhpur Triple Blast case the UP police fabricated an imaginary connection between the accused originally arrested and the terror suspects arrested many months and in some cases a few years after the arrest of original accused, he further wrote.

Khetan has hence urged the CJ to intervene and order an independent enquiry and fresh investigationin all of these seven cases and to direct "consequential relief to the victims of such operation".

He earlier wrote a similar letter petition to the Chief Justice of the Bombay High Court in “deliberate framing of Muslims in terror cases by the Anti-Terrorism Squad (ATS) of Maharashtra.”

1. I am a journalist of 12 years standing. During that period, I authored investigative reports on many important cases including those arising from the Gujarat riots of 2002, such as the NarodaGaon, NarodaPatiya and Gulberg Society massacres and the Best Bakery carnage. My investigative reports have received acclaim, and have also been used by investigators and the courts of law. In 2007 after my investigative report on the Gujarat riots was published widely, the National Human Rights Commission (NHRC) ordered an enquiry into the revelations in my report containing approximately 60 hours of video footage. On the orders of the NHRC, the tapes were tested by FSL, Jaipur and were found completely authentic. Subsequent to the publication of my investigations (or ‘sting operation’, in common parlance) in October 2007, the Supreme Court constituted a Special Investigation Team (SIT) to re-investigate many cases pertaining to the Godhra and post-Godhra riots. SIT cited me as a prosecution witness in three major riot cases. My testimony in this regard has been relied upon by the trial court in the NarodaPatiya case and several convictions were based on my evidence. I attach as ANNEXURE I, the judgment passed in the NarodaPatiya massacre case referring to my testimony. Meanwhile, I have testified as a prosecution witness in the NarodaGaon and Gulberg Society cases, the verdict in which is awaited.

2. After my ‘sting operation’ in the infamous Best Bakery case, the Supreme Court constituted a Quasi Judicial Committee headed by the then Registrar General, Supreme Court, which too found my investigative reports authentic and trustworthy. Many of the findings of the committee were based on my report alone. A copy of inquiry report submitted by the then Registrar General Mr. BM Gupta dated 27.05.2005 is Annexed hereto as ANNEXURE II. It was, inter-alia, my reportage on Hindutva terror groups that catalysed the investigation in the Malegaon blasts of 2006, the Samjhauta Express blasts, the Ajmer Sharif blasts and the Hyderabad Mecca Masjid blasts. As a result, the innocent persons hitherto arrested for these outrages were released on bail and the prosecution turned to those now believed to have been actually responsible for these terror attacks.

3. I am approaching your Hon’ble Court by this letter petition in public interest, for my recent investigative efforts as a journalist have led to a clear and compelling picture of the deliberate framing of innocent Muslims--most of them very young and very poor--in terror cases by the police agencies of Uttar Pradesh. The consequences should shock judicial conscience. In one instance an accused named Khalid Mujahid who was charged in Lucknow and Faizabad Courts Blasts, 2007 has recently died in a police van while being escorted between jail and courts. Mujahid was in jail for more than six years and the material I’m placing before this court shows that the evidence of his innocence as well as that of his three co-accused was deliberately kept from the courts. In five other other cases I’ve researched the accused have been languishing in jail for seven to eight years. In one of these cases the accused named Waliullah has been given a ten-year sentence. The material I’m placing before this court shows that Waliullah too was not involved in bomb blasts for which he had been charged. The matter thus is of great moment and equally great urgency.

4. For more than one year I’ve been researching terror investigations across the country. My research shows that in an overwhelming number of terror cases different police agencies have misled the courts in particular and the people in general by wrongly implicating innocent members of the minority community. In this regard I’ve recently filed a letter petition before the Bombay High Court drawing the Hon'ble Court’s attention to three terror cases where the lives of 21 Muslims had been wantonly destroyed by the Maharashtra Anti-terrorism Squad by tutoring witnesses (many of whom were stool pigeons), planting arms and explosives on these innocent persons and by extracting false confessions under the special act named MCOCA. A copy of the letter petition is placed as Annexure III.

5. During my research I have collected internal records also known as interrogation reports of several terror suspects recorded by different anti-terror agencies of the country that narrate an entirely contradictory story of at least seven terror cases related to the state of Uttar Pradesh than that told by the UP police to the courts currently trying these cases. Shockingly, some of these interrogation reports have been prepared by the agencies like Anti-terrorism squad of the Uttar Pradesh police itself—the very same police that is behind the arrests and investigations of some of these cases. These records show that the police have built prosecution cases that are at complete variance at the evidence that exists on their internal records.

6. But in order to ensure that the full truth never comes to light and that the courts in Uttar Pradesh never learn the farcical nature of these terror probes, the Uttar Pradesh Police have concealed these interrogation reports by taking advantage of the fact that these are almost never in the public domain. By keeping these reports under lock and key and also by doctoring them, on occasion, the agencies are seeking to sustain cases that they full well know to be bogus. I’m presenting before the court the very same material.

7. These seven terror cases are as following:

(i). SankatMochanMandir Blast, 7 March, 2006, Varanasi.

(ii). Cantonment Railway Station Blast, 7 March, 2006, Varanasi

(iii). Triple Blasts, 22 May, 2007, Gorakhpur.

(iv). Varanasi Court Blast, 23 November, 2007.

(v). Faizabad Court Blast, 23 November, 2007.

(vi). Lucknow Court Blast, 23 November, 2007.

(vii). Shramjeevi Express Blast, 28 July, 2005.

8. In all these abovementioned cases the UP Police have arrested and sent for trial nine members of the Muslim Community who have been in jail for anywhere between six to eight years. In the case of Shramjeevi Express Blast, three Bangladeshi nationals besides an Indian national are in jail for the last seven years. Recently, one accused named in the Faizabad and Lucknow Court Blasts, Khalid Mujahid, a teacher by profession and who was in jail for around six years, died under mysterious circumstances in judicial custody. As stated, a majority of these accused are poor and backward.

9. The internal records that I am presenting before this court suggest that an entirely different set of accused than those who had been originally arrested and chargesheeted in these seven cases are believed by other terror investigation agencies to be involved in these cases. Investigation agencies like the Maharashtra ATS, Gujarat Police and UP ATS have a version of the UP terror cases, which are completely at variance with what is lead before the courts in UP. A set of terror suspects were arrested much after the arrest of the original accused. What is extremely significant is that in the interrogation reports prepared by different agencies (including UP ATS) these terror suspects had neither suggested nor claimed of having any even remote linkage or connection with those accused who had been originally arrested for these blasts by the different arms of the UP Police.

10. But in the case of Lucknow and Faizabad Court Blasts and also in the Gorakhpur Triple Blast case the UP police fabricated an imaginary connection between the accused originally arrested and the terror suspects arrested many months and in some cases a few years after the arrest of original accused. Two completely conflicting narratives were thus married to retrospectively validate the old investigations. This cynical attempt to merge two conflicting narratives in order to cover-up the wrongful arrests made previously, gets exposed by the material I’m placing before this court.

12. In most of these seven terror cases the original accused have also been booked separately for recovery of arms and explosives. If these accused were not involved in these bomb attacks to begin with, as these internal records suggest, then serious questions also arise about the genuineness of these recoveries.

13. My intent is not to establish guilt of any individual. I want to bring to notice of this Hon’ble court the full facts in each of these seven blast cases that were never presented by the investigating agencies before the courts. The material I’m placing compellingly establishes that the evidence and revelations that militated against and debunked the prosecution theory in each of these seven terror attacks were either conveniently brushed under the carpet or altered and manipulated to validate the sham investigations done previously. This bewildering scale of manipulation betrays the absolute contempt for the due process of law, justice and truth displayed by the Uttar Pradesh police.

14. What also emerges is that the State of Uttar Pradesh has on different occasions and before different courts including the Allahabad High Court has cynically perpetrated gross injustice by concealing material evidence of the innocence of those accused, and instead is appearing to be bountiful by wanting to withdraw prosecution. While on one hand the state of Uttar Pradesh has been seeking to withdraw some cases against the accused originally named in Sankatmochan Blast, Varanasi, Gorakhpur Blasts and Faizabad and Lucknow Court Blasts on the grounds of public interest and communal harmony, on the other hand the material that could have established their innocence and which is in the possession of state police agencies has not been shared with the courts. Thus what is really a constitutional right of these innocent men to have their innocence established and their liberty and dignity restored is being turned into an undue State largess with an eye on political and electoral gains, thus causing much resentment all around.

15. The gruesome acts of terror demand equal justice and a search of full and unvarnished truth. But this unstated State policy of weaving a web of lies and half truths is not only eroding the very core of the rule of law, it is also gnawing away at the mutual trust between different communities and rupturing our society. Recently a few advocates filed a PIL before the Allahabad High Court challenging the government’s proposed move of withdrawing certain terror related cases against members of the Muslim Community. On the other hand such sham police investigations and deliberate targeting of a certain section of the citizenry by the agencies is causing alienation among the members of the minority community.

16. As a result neither the victims of ghastly terror attacks nor those innocent youths who have been falsely implicated are being given justice. Every time an innocent person is framed in a terror case, the real culprits do not just get away but also get emboldened. Therefore, what I am placing before you is not just aberrations in investigations or minor breaches, but a whole stylised operation conducted with active prejudice. If unchecked, such a course will only serve to increase the terror threat that this nation faces and further endanger our internal security.

17. I am aware that normally, investigation of crime is the task of the police and verdicts of guilt or innocence, the realm of courts. What makes me intervene in this process is the fact that the same has become the reverse of what it is intended to be. When the police deliberately obstructs justice and misleads courts of law, it cannot be left unchecked, and it is my duty as a citizen and a journalist to invite the attention of the highest custodians of justice to the facts that I have unearthed, particularly when the consequences to our national security are so dire.

18. The material I seek to place before this Hon’bleCourt, is for the sake of convenience put under the following heads SadiqIsrarShaikh, ArifBadar alias Laddan, MohdSaif, SaifurRahman, Sarwar and Mohd. Salman.

18.1. These heads are named after the terror suspects arrested by different police agencies between September 2008 and March, 2010. The Investigative agencies have on their record a single, integral terror plot of which the above-mentioned six arrestees have been claimed to be a part. The narrative given by these six accused is consistent with the case of different agencies in different cities outside Uttar Pradesh. According to the internal records of these multiple investigative agencies all these six accused have confessed to their involvement in the single terror conspiracy of which these seven terror strikes pertaining to state of UP (as mentioned above) were also a part. These records show that these six terror suspects have given a detailed and meticulous account of their involvement and involvement of other accomplices in these bomb attacks. Significantly the ‘confessions’ nor the investigation reports of these six suspects make any mention whatsoever of the involvement of the nine youths who were originally arrested and chargesheeted by the UP Police for these blasts. In fact the terror plot as narrated by these six terror suspects as recorded by different agencies on different dates completely debunks the prosecution case as its stands today in each of these seven terror strikes in both its material and minute details.

20 SadiqIsrarShaikh son of Israr Ahmed Shaikh Permanent Address; Phoolpur Tehsil, Azamgarh, temporary address at the time of arrest: Trombay, Mumbai (arrested in September, 2008)

20.1 In July and September 2008, there were serial blasts in Delhi, Ahmedabad and Surat (aborted blasts). Following some leads in these blasts, the Mumbai Crime Branch arrested one Sadiq Sheikh along with 20 other accused from Mumbai and other parts of Maharashtra in the month of September 2008.

20.2 This was a crucial juncture in terror investigations in India. In a span of a little over one year between August 2007 and September 2008, there were terror bombings in Bangalore (seven serial blasts of July 2008), Hyderabad (Lumbini Park and GokulChaat Blasts of August 2007), UP (Synchronized blasts at Court premises in Lucknow, Varanasi and Faizabad, November 2007), Jaipur (serial blasts of May 2008), Ahmedabad (21 serial blasts in July 2008) and Surat (Aborted attempt as eighteen Bombs malfunctioned) and Delhi (Five syncronized bomb blasts in market places of Delhi in September, 2008).

20.3 The series of bombings across India indicated a single, integral conspiracy and consequently brought several investigating agencies of different states together and pooling of information. In other words the set of men arrested following the 2007 and 2008 set of bombings across the country were interrogated by Ahmedabad, Delhi, UP, Karnataka and other police teams of other states and were subsequently made common accused in all these blasts pertaining to the period of 2007-08.

20.4 Sadiq Sheikh and his alleged ‘Indian Mujahideen’ accomplices were interrogated by different police agencies on different dates. Each agency prepared detailed Interrogation Reports (IRs). My sources in Mumbai police and state police agencies of Andhra Pradesh, Gujarat, Uttar Pradesh and Karnataka who were involved in investigating ‘Indian Mujahideen’ and its alleged involvement in the 2007 and 2008 blasts provided me the Interrogation Reports of Sadiq Sheikh and others prepared by each of these agencies (All these interrogation reports of SadiqShaikh are annexed as Annexure IV).

20.5 The significant aspect of these IRs for this Court is that Sadiq not only spoke about his involvement in the blasts that occurred during 2007-2008 but also the following blasts that occurred between 2003 and 2007:

1. Dashavmeghghat, Varanasi, 2004 (the bomb packed in a container reportedly failed to explode)

2. Shramjeevi Express Blast ,Jaunpur, UP., 2005

3. Diwali Blasts, Delhi, 2005

4. Sankatmochan Temple and Cant Railway Station Blasts, Varanasi, 2006

5. Mumbai Train Blasts, 2006

20.6 The agencies have themselves claimed (both in court and in public) that Sadiq’s interrogation led to the arrest of over 70 terror suspects by UP ATS, Hyderabad CIC, Ahmedabad Crime Branch, Rajasthan ATS and Delhi Special Cell. The content of these reports, and ‘confessions’ etc is part of the charge-sheets filed by different agencies. But curiously Sadiq and his accomplices were charge-sheeted in only those blast cases in which the investigation was still not completed. Hyderabad Blasts (Gokul Chat and Lumbini Park) of 2007, Ahmedabad and Surat (aborted) Blasts of 2008, Delhi Blasts of 2008 were some of the cases in which the alleged Indian Mujahideen members were charges-sheeted.

20.7 But those of Sadiq’s “revelations” that related to the blasts like Shramjeevi Express and Sankatmochan Temple were conveniently brushed under the carpet.

20.8. All these agencies were equally aware that an entirely different set of persons had been put on trial for these blasts, which set of accused could only be innocent, if the later 2008 Interrogation reports were true.

20.9. Thus at least after 2008 September, all the said agencies including UP Police were privy to the nature of evidence and revelations pertaining to the Shramjeevi and the 2006 Varanasi blasts among other blast cases. They also heavily relied on these revelations in the investigations pertaining to the 2007-2008 bombings. But those revelations that talked about the blasts carried out before 2007 were ignored because those cases had already been claimed to have been solved. This policy of pick and choose raises a serious question about the integrity of terror investigations and the conduct of the UP Police.

20.10.The lack of bonafides is further evident from the fact that no attempt was made to arrive at the truth or exonerate one set of obviously innocent persons. None of these agencies placed the entire relevant material before the courts trying an entirely unconnected set of men for the Shramjeevi Express Blast, Sankatmochan and Cantonment Railway Station Blasts. Why?

20.11.As per these internal records, SadiqShaikh along with one AtifAmeen (who was killed in Batla House Encounter) had planted the bomb at Shramjeevi Express with absolutely no connection with the four persons (three of whom are Bangladeshi nationals) who had already been arrested and chargesheeted by the Railway police. If SadiqShaikh is to be believed than while he and his other Indian Mujahideen accomplices kept carrying one terror strike after another between 2004 and 2008, different state police agencies kept framing unconnected and innocent persons in these blast cases.

20.12.Again I’d like to reiterate before this Hon'ble court that my intent is not pass a verdict of guilt against anyone. But it is to only highlight the blatant discrepancies and contradictions in terror investigations.

21. ArifBadar son of Badruddin (72); Permanent Address- Village Isroli, Sarai Mir, Azamgarh, UP (arrested in September, 2008)

21.1 Like SadiqShaikk, AribBadar was also arrested by Mumbai Police. He was arrested on 24.09.2008. During interrogation before every agency ArifBadar confessed to his involvement in almost all the blasts done by “Indian Mujahideen” between 2004 and 2008. He was interrogated by different agencies on different dates. These internal interrogation reports show that ArifBadar was an electrician by profession and played a specialized role of preparing timers for the bombs that were then planted by his accomplices. Interrogation Reports of ArifBadar prepared by Ahmedabad and Mumbai Police Crime Branch are placed at Annexure V.

21.2 As per these interrogation reports ArifBadar made timers for the bombs that were planted by his accomplices in Sankatmochan, Cantonment Railway Station and busy market places in Varanasi in 2006, the bombs that were planted in the market places of Gorakhpur city in May, 2007 and Lucknow, Faizabad and Varanasi Courts in 2007 among many other blasts carried out in other states like Maharashtra, Delhi and Gujarat in which Arif claimed to have made timers.

21.3 Also ArifBadar is on record to have confessed to being a core member of this single, integral terror plot that was first hatched in 2003-2004 and as per which blasts were carried out between 2004 and 2008. Badar gave descriptions of all those who were involved in these blasts. But the four youths—Ubaid-ur-Rahman, AlamgurHussain, Hilaluddin (all Banglsdeshis) and NafequlBiswas--who were chargesheeted in Shramjeevi Express Blasts, one person named Tariq Qazmi who was chargesheeted in Gorakhpur Blasts of 2007, a Muslim cleric named Waliullah who was chargesheeted for 2006 Varanasi blasts and four persons—Tariq Qazmi, Khalid Mujahid, Sajad-ur-rahman and MohdAkhtar-- who have been chargesheeted for Faizabad and Lucknow Court Blasts find no mention whatsoever in his interrogation reports. Though ArifBadar claimed to have played a role in all these blasts and has also claimed to have intimate knowledge about all those who were involved along with him in these abovementioned blasts. Still the UP police nor other agencies brought all this material to the notice of the courts trying Shramjeevi , Varanasi, Gorakhpur, Lucknow and Faizabad blasts. Pertinent to note is the fact that ArifBadar’s revelations and admissions have been incorporated in those terror cases (like Ahmedabad blasts) that occurred during 2007-2008 and in which the investigation was still open. But in cases like Varanasi, Gorakhpur and UP Court Blasts, ArifBadar’s revelations were brushed under the carpet. Why?

22. SaifurRahman son of Abdul Rahman Ansari, resident of Badarka, Azamgarh (arrested in April, 2009)

22.1 In April 2009, another alleged Indian Mujahideen operative SaifurRahman was arrested by the Madhya Pradesh police. I’m placing at Annexure VI, the interrogation report of SaifurRahman prepared by none other than but the UP ATS.

22.2. As per this IR, SaifurRahman has given a detailed account of the several blasts like Ahmedabad and Jaipur blasts he was involved in.

22.3 What is significant for this court is the fact that he admitted to his involvement in the conspiracy of UP Courts Blasts and specifically admitted to his involvement in planting the bomb at Faizabad Court Premises. What is equally significant is the fact that he has made no mention of the four accused—namely, Dr Tariq Qazmi, Khalid Mujahid, Sajad-ur-rahman and MohdAkhtar who had already been chargesheeted for the Faizabad and Lucknow Court Blast. As per this IR there is absolutely no connection of the above mentioned four accused in the UP Court Blasts. In fact the narration of the conspiracy given by SaifurRahman is completely different from the one pressed by the UP ATS in the concerned courts.

22.4. Truth cannot have different versions for different purposes. But when it comes to terror cases it appears that there is one for agency’s internal consumption and another for the courts. Between courts also one version is pressed before the courts in one state and another (and contradictory version) is peddled before other courts. Why has UP,ATS concealed these material facts pertaining to SaifurRahman’s disclosure from the courts that are trying Faizabad and Lucknow court blast cases. One of the accused named Khalid Mujahid, who if SaifurRahman is to believed had no connection with the blasts, has already died in judicial custody.

22.5. Like other so-called Indian Mujahideen suspects, SaifurRahman has been shown accused in selective blast cases as per the whims and fancies of the agencies. Some of his disclosures like that pertaining to Ahmedabad Blasts have been accepted by some agencies while that pertaining to UP Court Blasts have been conveniently brushed aside.

23. MohdSaif, son of Shadab Ahmed resident of SanjarpurAzamgarh, UP (arrested by Delhi Police in September 2008)

23.1 I am placing as Annexure VII, four interrogation reports of MohdSaif prepared by three different agencies, namely, UP ATS, Maharashtra ATS and Ahmedabad Crime Branch. All these IRs are identical in their material particulars.

23.2 Almost seven months before SaifurRahman’s arrest, a terror suspect MohdSaif was arrested from Batla House.

23.3. Saif is said to have given a similar account of Faizabad, Lucknow and Varanasi Court Blasts conspiracy as later narrated by SaifurRahman seven months after Saif’s arrest.

23.4 Saif spoke about his involvement in the blasts at Lucknow, Faizabad and Varanasi Court Premises, Gorakhpur Blasts of year 2007 and Varanasi Blasts of 2006 besides 2008 Jaipur, Ahmedabad and Delhi Blasts. But Saif’s disclosures have absolutely no reference to Waliullah who had been charged for Varanasi Blasts. Similarly Saif doesn’t make any mention of Dr. Tariq Qazmi who had been charged for Gorakhpur Blasts and Khalid Mujahid and others who had been charged for the Court Blasts. Forget connection in the blasts, neither Saif, nor SadiqShaikh, nor SaifurRahman nor ArifBadar make any mention of even remote acquaintance of these men who had been originally arrested for these attacks.

24. MohdSarwar son of Master MohdHanif, resident of Village Chandpatti, Tehsil Sangdi, District Azamgarh (arrested in January, 2009).

24.1. I am placing as Annexure VIII, an interrogation report of a terror suspect MohdSarwar prepared by the UP ATS. Sarwar was arrested in January, 2009.

24.2 As per this IR, Sarwar was involved in 2006 Varanasi blasts. Besides his own involvement Sarwar talks about the involvement of others, namely AtifAmeen, MohdSaif, Shadab Malik, Ariz alias Junaid and AsadullahAkhtar (all residents of Azamgarh).

24.3 Both Sarwar and Saif were arrested several months apart. Both have given a similar account of the 2006 Varanasi blasts. More significantly, both make no reference to Waliullah, an imam of a mosque in Allahabad, and his three alleged accomplices (who the UP police claimed were Bangladeshi nationals and thus could never be identified or traced). In other words, if Saif, SadiqShaikh, ArifBadar and Sarwar are to be believed, then Waliullah had no role in the 2006 Varanasi blasts.

24.4.Waliullah has already been given a ten-year sentence for the recovery of arms and explosives by a court in Lucknow. Both these cases that is the case of recovery and Varanasi blasts are inter-connected. The question that arises is if Waliullah was not involved in the blasts, then how authentic and genuine were the recoveries on the basis of which he was given ten-year sentence? All this contradictory material was neither placed before the Lucknow court that gave the 10- year sentence nor has it been placed before a Ghaziabad court trying the Varanasi blasts. Waliullah has been in jail since 2006.

25. Mohd Salman, son of MohdShakeel, Permanent of Sanjarpur, Azamgarh

25.1 The last in the series of these six arrests was of Mohd Salman, 18 years, in March, 2010. I’m placing at Annexure IX, the interrogation report of Salman prepared by the UP ATS.

25.2 In this IR, Salman talks about his involvement in Gorakhpur Blasts of 2007, UP Court Blasts of 2007 besides other blasts like Jaipur and Ahmedabad Blasts of 2008.

25.3. Salman corroborates the account of Gorakhpur and Court Blasts as given by the likes of MohdSaif, SaifurRahman and ArifBadar alias Laddan who were arrested and interrogated many months before his arrest. None of these suspects had the occasion to know as to what others had told the interrogators.

25.4 Most of these interrogations reports have been marked as classified and have never been shared with any court.

26. UP Police tries to mislead the Courts.

26.1 In the face of this overwhelmingly contradictory material cited herein, the UP Police came up with a new theory. In a few submissions made before courts, the UP police came up with the theory that 2006 Varanasi blasts and 2007 Court Blasts were done jointly by Indian Mujahideen and Bangladesh based terror outfit HUJI. It was done so because all those nine persons who had been originally arrested were shown as members of HUJI. But all the interrogation reports cited above have absolutely no reference to HUJI or its members.

26.2 The question is on what basis has the UP Police harmonized their old investigations with the subsequent revelations? If the IRs of these alleged Indian Mujahideen terror suspects have not even remote reference to HUJI or those who had been arrested by the UP Police then on what grounds has the UP Police reached the conclusion that these were joint operations. The only logical conclusion one can draw is that it was done to cover-up the previous wrongful arrests so that delinquent cops don’t have to face the consequences of manufacturing evidence and implicating innocent persons.

26.3. The absurdity of this theory is further brought out by the fact that this “joint HUJI-IM operations theory” was never pressed in the shape of a chargesheet before the courts concerned.

26.5 These are seven investigations that I have researched in the state of Uttar Pradesh. There is no knowing how many other cases in the State have similar features, and given the carte blanche the Governments have tended to give our anti-terror outfits, that function with absolute power under absolute secrecy, in all probability the story of perverting the criminal justice system goes beyond just these seven cases. I’ve already brought to the notice of the Bombay High Court the framing of 21 innocent Muslim youth in three terror cases, namely Mumbai train blasts of 2006, Malegaon Blasts of 2006 and Pune German bakery Blast of 2010.

26.6 These are issues of grave public importance that go beyond mere legality. It’s not just the security of our nation but also the very idea of Indian democracy that is under threat and so I have straightaway chosen to put this material across to every institution concerned with upholding human rights, constitutional values and accountability. Thus I approach this Court by way of public interest and in view of the immense issues involved, have also, apprised other statutory authorities concerned with human rights, minorities protection, police training institutions and media bodies and I have also arranged for the matter to enter the public domain as it is an issue of grave public importance, which in a democracy, the people are entitled to know.

26.7 I am doing this at the earliest opportunity. I may be given the permission to cast this petition in a more formal mode if required.

PRAYERS

I pray to this Hon’ble this Hon’ble Court to:

(i) Order an independent commission of inquiry into the conduct of the investigating officers, in the investigation of crucial cases such as have been referred to in these petition;

(ii) Order re-investigation of all the seven terror cases referred herein by the National Investigation Agency (NIA) so that the real culprits can be brought to justice.

(iii) Direct appropriate action against the police officers found responsible for their flagrant violation of constitutional values and fundamental rights.

(iv) Direct consequential relief to the victims of such wrongful and bogus investigations.

On a mission to revive Arabic calligraphy in India

Hyderabad : As beautiful as pearls, his calligraphic pieces adorn mosques in different parts of the world, international exhibitions, drawing rooms and even private jets.

Muqtar Ahmed, an Arabic calligrapher, has achieved what many only aspire for and he is now on a mission to revive the dying art of calligraphy in the country.

The 45-year-old recently became the only Indian to obtain an 'Ijazah' (Masters diploma) from Istanbul-based Research Centre for Islamic History, Art and Culture (IRCICA) of the Organisation of the Islamic Cooperation (OIC).

This degree may fetch him a good job in the Arab world, where Islamic art is greatly valued. But his dream is to revive the art in India, where it once enjoyed the royal patronage.

For this calligrapher from Andhra Pradesh settled in Bangalore for over two decades, Arabic calligraphy is worship.

"Writing Koranic verses and Hadith (sayings of the Prophet) is worship. These works are sawab-e-jaria (continuous reward)," Muqtar told IANS in an interview.

"The aesthetics and refinement are the specialities of the Islamic art. There is no beautiful script in the world other than Koran," said the son of a farmer, who now teaches at the Institute of Indo-Islamic Art and Culture in Bangalore.

Muqtar has participated in calligraphy exhibitions and conferences in Dubai, Sharjah, Abu Dhabi, Madina, Malaysia and Algeria. "The Arabic calligraphy with all its delicacy is at its peak in the Islamic world."

One of his works was purchased by then governor of Madina in 2011 when he participated in the international exhibition in the holy city in Saudi Arabia.

His international works in collaboration with Mamoun Luthfi Sakkal of the US include calligraphic pieces for a private jet and a mosque in Canada.

Son of a farmer hailing from Ranjhol in Medak district, about 100 km from here, he was interested in calligraphy from his school days. He started working for Urdu daily 'Salar' in Bangalore. Always keen to learn new things, he looked for continuous improvement.

Rendered jobless after the newspaper replaced calligraphy with computers in the early 1990s, Muqtar started writing wedding cards to make a living. But that was not his goal.

He got in touch with Sakkal, who guided him in classical international Arabic calligraphy. He also learnt from other renowned calligraphers including Mohammed Zakariya of the US through correspondence.

Muqtar then sent his works to IRCICA. After the selection, he visited Turkey in 2008 to personally learn the nuances of the art from arguably the world's best calligraphers - Hassan Chalabi and Dawood Biktash.

He spent all his savings to meet the huge expenses. He again visited Turkey in 2011 and for the third time in April this year to receive the degree.

Muqtar, who uses hand-made and special pens for his writings, said he achieved precision with perseverance. "Even a small piece of calligraphy takes several hours. You have to write a letter hundreds of times to achieve the accuracy," he said.

Muqtar's mission is now to teach the art to as many people as possible. He believes the art can be revived in India as many youngsters are taking interest. "There is a need to bridge the gap as no attention was given to basics for over 300 years."

In the past the rulers in India used to promote calligraphy and take pride in owning the masterpieces. Only a few of those works remain in museums and numents.

Muqtar believes if companies owned by Muslims and the educational institutions come forward they can make for a change.

The institute in Bangalore was set up by Bearys Group of Companies. Muqtar, with the group's support, plans exhibitions in all major cities in India, workshops to teach the basics to those interested and invite top calligraphers from abroad.

He also plans to publish books and do research on the calligraphy inscribed on monuments.
