Aligarh: “The judicial system in India has failed to deliver justice to the litigants. It is increasingly losing its effectiveness and is limited both by internal and external factors,” said Gopal Subramanium, former Solicitor General of India, while delivering Dr. Ambedkar Memorial Lecture on “Effectiveness and Limitations of the Judicial System” at the Department of Law in the Aligarh Muslim University.
Subramanium, who is also a former Chairman of the Bar Council of India, emphasized that the government should identify and address each of the constituent units of the judicial system and work upon each of them simultaneously.

He was of the view that absence of an effective judicial system hindered the exercise of rights and freedom and its presence was necessary for maintaining the rule of law.
He stated that backlog, delay and inefficient judicial system, eroded public trust and confidence in legal institutions and eventually weaned faith in the rule of law. It is shocking that the very reasons for which tribunalisation had been restored today are plaguing even the tribunals. There was profound delay, inefficiency and backlog even at the tribunals. Thus, clearly, there was something inherently wrong with the judicial system which had not been appropriately diagnosed by the government, he added.
Referring to the verses from Holy Quran, he said, “We must remind ourselves that the act of judging is a divine virtue”. He further said that there is a beautiful phrase in the Verse 135 of Surah Al-Nisa of Holy Quran that articulates the principles of constitutional morality and concept of justice.

He said that he was aware of the contribution of Sir Syed Ahmad Khan in the field of promotion of higher education. He paid rich tributes to the founder of this institution, Sir Syed Ahmad Khan and his illustrious son, Justice Mohammad Mahmood who was a great scholar of Indian justice system.
Subramanium said that as an Attorney General he studies the case for the Minority Character and assured the University community that he would plead the case before Supreme Court if the University wished.
Earlier in his presidential remarks, AMU Vice Chancellor, Lt. Gen. (Retd.) Zameer Uddin Shah said that Aligarh’s brand name is linked with the Faculty of Law and it would continue to provide good lawyers and judges to the country.
